These Terms of Service ("Terms") govern your use of the dollyboard website and invoicing platform at dollyboard.com (the "Service"), operated by Westlabs LLC ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent that you meet these requirements.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@dollyboard.com if you suspect unauthorized access to your account.
3. Use of the Service
Permitted use
You may use the Service to create, manage, send, and store invoices for legitimate business purposes.
Prohibited use
You agree not to:
- Use the Service for any unlawful purpose or to create fraudulent invoices.
- Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
- Interfere with or disrupt the Service or servers connected to it.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to send spam, phishing, or unsolicited communications.
- Resell, redistribute, or sublicense the Service without our written consent.
4. Plans and Pricing
- Free plan: the Service offers a free plan with unlimited invoices and clients. We reserve the right to modify free plan features with 30 days' notice.
- Paid plans: paid plans are billed monthly or annually as indicated at the time of purchase. Prices are listed on our pricing page and may change with 30 days' notice.
- Refunds: paid plans are non-refundable except where required by applicable law. You may cancel your subscription at any time, and it will remain active until the end of the current billing period.
5. Your Data
- Ownership: you retain all ownership rights to the data you submit to the Service, including business information, client data, and invoice content.
- License: you grant us a limited license to use, store, and process your data solely for the purpose of providing the Service.
- AI processing: when you use AI invoice generation, text descriptions you provide are processed by our AI systems to generate invoice content. We do not use your data to train AI models.
- Export: you may export your data at any time through the Service.
- Deletion: if you delete your account, we will delete your data within 30 days, except where retention is required by law.
6. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by Westlabs LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
7. Third-Party Services
The Service may integrate with or link to third-party services (payment processors, email providers, etc.). We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is governed by their respective terms.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
dollyboard is an invoicing tool, not an accounting, tax, or legal advisory service. You are solely responsible for the accuracy of your invoices and compliance with applicable tax laws.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WESTLABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless Westlabs LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law.
- Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 10, and 13 survive termination.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Curry County, New Mexico.
